Tasman may at its discretion grant Company a license, free of any fees, to evaluate the Tasman Barcode Reader Java ME SDK (henceforth the Product) for a period of sixty days. The Company, in its sole discretion, may elect to enter into a mutually agreeable contract with Tasman to obtain a license for continued use of the Product. However, Company is under no obligation to purchase the Product or enter into a contract to license the Product. Upon expiration of the evaluation, unless mutually extended in writing by Tasman and Company, Company will certify to Tasman, in writing, that all copies or partial copies thereof have been deleted from every computer library and storage device under Company’s control; are no longer in use by or on behalf of Company; and have been destroyed.
Company shall keep confidential all documentation and information provided by Tasman; and Company may not copy or disclose the same or use the same for any purpose other than the evaluation of the Product. Company shall not reverse engineer the computer code or data in the Product.
Company agrees that Tasman makes no warranties or representations, whether express or implied, including, without limitation, any implied warranties of merchantability and fitness for a particular purpose with respect to the Product and that in no event will Tasman be liable to Company or to any other party for any loss, including time, money, goodwill and consequential damages which may arise from Company’s use of the Product.
